Il signore che vedete ritratto nella foto qui a fianco si chiama Richard Posner ed è un giurista della Corte di Giustizia di Chicago che sta esaminando la denuncia di Apple contro Motorola e, in seconda battuta contro HTC a proposito della violazione del brevetto 263. Secondo Florian Mueller, uno dei massimi esperti americani di brevetti, il giurista avrebbe deciso a favore della casa di Cupertino nell’interpretazione legale che vedrebbe la violazione dell’API (App Programming Interface/Interfaccia di Programmazione in tempo reale) che farebbe interagire uno o più sottosistemi. Secondo i legali di Apple questa sarebbe una delle “fonti” a cui Andy Rubin si sarebbe ispirato per la creazione di Android; HTC sarebbe consapevole della violazione e starebbe trattando con Cupertino i termini di un accordo di risarcimento. Data la notorietà del giurista, il vantaggio che Apple acquisirebbe in caso di sentenza a suo favore sarebbe così importante che Google potrebbe dover riprogettare il suo sistema operativo per non incorrere ancora nella violazione.

A pro Apple Chicago Court decision (still not confirmed) could produce many problems to Motorola and Google

The gentleman you see in the picture above is called Richard Posner and he is Court of Justice in Chicago’s jurist, that is investigating the Apple lawsuit against Motorola and, in the background, HTC for patent 263 infringement. According to Florian Mueller, one of the leading American experts on patents, the jurist would decide in favor of the house of Cupertino on legal interpretation that would see the violation of the API (app programming interface/Real-time Programming Interface) that would interact one or more subsystems. According to Apple’s lawyers this would be one of the “sources” that inspired Andy Rubin to create Android OS; HTC would be aware of the violation and would be dealing with Cupertino terms of an agreement on compensation. Given the jurist reputation, the advantage that Apple would acquire in case of ruling in its favor would be so important that Google may have to redesign its operating system in order to avoid the violation.
